What Makes an Uber Accident Claim Different From a Regular Car Accident?

An Uber accident may look like an ordinary motor-vehicle collision, but the insurance, evidence, and liability issues can be substantially more complicated. An Uber accident claim requires determining the driver’s app status, identifying the applicable insurance, and preserving rideshare records that can establish coverage and fault. A driver waiting for a request is in a different insurance period from one traveling to an accepted pickup—even when no passenger has entered the vehicle. The driver’s personal automobile policy may exclude rideshare use, while an injured passenger’s own PIP or uninsured motorist coverage may provide benefits. Trip timestamps, GPS information, messages, and cellphone activity can help resolve disputes about the driver’s status and conduct. A claim against the negligent driver also presents a different legal question from a claim against Uber itself.

The investigation begins with four questions: Who caused the accident? What was the Uber driver doing through the app? Who was injured? Which insurance policies apply? Those answers guide the coverage investigation, evidence preservation, and preparation of the injury claim.

Who Can Make an Injury Claim After an Uber Accident in Florida?

Uber passengers, drivers, occupants of other vehicles, pedestrians, bicyclists, motorcyclists, and eligible families may have claims when negligence causes injury or death. The injured person’s relationship to the trip affects which benefits and claims should be investigated.

Injured Uber Passengers

An injured Uber passenger may pursue the Uber driver, another driver, or both when their negligence caused the injuries. A passenger usually has no control over either vehicle, but insurers may still disagree about who caused the crash. That dispute should be resolved with evidence rather than leaving the passenger between competing adjusters.

Drivers and Passengers Hit by an Uber Driver

People in another vehicle may pursue a negligent Uber driver even though they never booked an Uber ride. The injured person’s own PIP and other automobile coverage remain relevant. Rideshare insurance is not limited to claims by paying passengers.

Pedestrians and Bicyclists Hit by an Uber Driver

A pedestrian or bicyclist struck by a negligent Uber driver may pursue compensation for the resulting injuries. Lack of physical protection can make these collisions especially serious. The investigation should address the crossing or bicycle route, visibility, traffic controls, and the driver’s opportunity to avoid impact. Our Hollywood pedestrian accident page discusses those liability issues.

Motorcyclists Hit by an Uber Driver

An injured motorcyclist may pursue a negligent Uber driver and applicable liability coverage, but ordinary automobile PIP rules do not apply to motorcycles in the same way. Motorcycles are excluded from the statutory vehicle definition used for ordinary PIP purposes. Our Hollywood motorcycle accident lawyer page explains the distinct coverage and injury-threshold issues.

Uber Drivers Injured by Another Motorist

An Uber driver can pursue a motorist whose negligence caused the driver’s injuries. Driving for Uber does not eliminate that claim. Personal-policy rideshare exclusions and any applicable endorsements need careful review; Uber’s liability policy does not automatically compensate its own driver for injuries caused by someone else.

Fatal Uber Accidents and Wrongful Death Claims

The estate’s personal representative may bring a Florida wrongful-death action for eligible survivors and the estate. Recoverable damages depend on the family relationship and circumstances. Our discussion of fatal motor-vehicle accidents and Florida wrongful death explains those claims.

How Does Uber Accident Insurance Coverage Work in Florida?

Florida’s rideshare liability requirements change when a driver goes from waiting for work to an accepted passenger trip. The following table summarizes the periods under section 627.748, Florida Statutes.

These are statutory liability requirements. Qualifying coverage may be maintained by the TNC, driver, vehicle owner, or a combination of policies as authorized by law. The declarations, endorsements, insured status, and accident facts determine how a particular policy responds.

When Does Uber’s $1 Million Liability Requirement Begin and End?

The accepted-trip period begins when the driver accepts a passenger’s request and ends when the last rider exits and no longer occupies the vehicle. Travel toward the accepted pickup is included. If an insurer treats a crash during that travel as a waiting-period accident, the acceptance timestamp can become decisive.

Why Obtain the Actual Insurance Policy?

An online insurance certificate does not establish all the terms of the policy covering the accident. The policy and endorsements may identify insureds, exclusions, limits, and other conditions that a certificate does not show. Rental or fleet agreements may also matter. The documents should be matched to the accident date rather than relying on an insurer’s current online summary.

What Insurance Policies Should Be Investigated After an Uber Accident?

The investigation should distinguish benefits available to the injured person from insurance covering a legally responsible driver. PIP addresses certain early expenses; liability coverage responds to covered claims against an insured; UM/UIM can address injuries caused by an uninsured or underinsured motorist.

Who Pays Medical Bills? Florida PIP and Other Medical Coverage

PIP is generally one of the first sources of medical benefits to investigate after an Uber passenger is injured. A passenger’s own policy or qualifying resident-relative coverage may follow the passenger into the rideshare vehicle. When neither exists, coverage associated with the occupied vehicle may become relevant under Florida’s priority rules.

PIP generally pays 80% of covered medical expenses and 60% of covered lost income, subject to statutory and policy limitations. Initial medical services generally must be obtained within 14 days. An emergency medical condition can affect access to medical benefits up to $10,000; a lower $2,500 medical limit may otherwise apply.

Health insurance and medical-payments coverage, when available, may help with treatment while a liability claim is pending. Keep bills and payment records because PIP does not cover every expense, and liens or reimbursement obligations can affect the eventual settlement.

Liability Insurance for the Drivers and Other Responsible Parties

The Uber driver’s coverage and another motorist’s bodily-injury policy may both require investigation when fault is disputed or shared. A policy’s existence does not establish liability. The claim still needs evidence connecting the insured’s negligence to the injuries.

Vehicle ownership, rental, fleet, employment, or maintenance relationships can reveal other parties or insurance. Agreements and endorsements should be examined when those relationships are present, including whether the vehicle’s use was covered.

Personal and Resident-Relative UM/UIM Coverage

An injured person’s own UM/UIM policy or a qualifying resident-relative policy may provide benefits when the responsible motorist lacks sufficient bodily-injury coverage. Insured status, household residency, stacking, exclusions, and notice requirements can affect eligibility. Dan reviews these issues before accepting an insurer’s statement that no coverage exists.

Does Uber Provide Uninsured or Underinsured Motorist Coverage in Florida?

Uber’s liability insurance does not automatically establish UM/UIM coverage for an injured passenger or driver. Florida’s rideshare statute refers to UM/UIM coverage as required by the general UM statute, section 627.727. The actual policy and any rejection documents must be reviewed.

In Progressive Express Insurance Co. v. Monasterio, an unpublished Eleventh Circuit decision involving an Uber driver, the court concluded that Florida law did not require UM coverage under the particular policy. It covered unspecified vehicles, and the corporate policyholder had signed a written rejection. The decision did not directly resolve every possible passenger UM claim.

A passenger’s personal or qualifying household policy may provide coverage even when the rideshare policy does not. Our Hollywood uninsured motorist lawyer page explains resident-relative claims, rejection disputes, and stacked versus non-stacked coverage.

Two Hypothetical Examples: Applying the Uber Insurance Rules

These fictional examples illustrate coverage questions; they are not firm case results or predictions of recovery. Each assumes the stated facts can be proved. Actual policy terms and circumstances still control.

Hypothetical 1: An Uber Driver Causes a Crash on the Way to an Accepted Pickup

The accepted-trip liability requirement applies even though the passenger has not yet entered the Uber. Suppose a driver accepts a ride at 8:02 p.m. At 8:06 p.m., while traveling to the pickup, the driver runs a red light and injures someone in another car. The insurer initially describes the driver as waiting for a ride because the vehicle was empty.

The acceptance record, route information, and crash timing show why an empty vehicle does not settle the coverage question. On these assumed facts, the at-least-$1-million primary liability requirement applies. Traffic evidence must still establish negligence, and medical and financial records must establish damages. The insurance limit does not determine the settlement amount.

Hypothetical 2: A Hit-and-Run Driver Injures an Uber Passenger

The passenger’s own UM coverage may be relevant even though the passenger was riding in someone else’s vehicle. Suppose another driver runs a red light, hits an Uber, and flees. The Uber driver did nothing negligent. The injured passenger owns a car and has UM coverage, but the applicable rideshare policy provides no UM benefits.

The passenger’s UM policy should be examined for insured status, exclusions, notice requirements, and any proof required for the hit-and-run claim. PIP should also be investigated for eligible early expenses. Video, witnesses, vehicle debris, and trip records may help establish how the crash happened or identify the fleeing driver.

The Uber driver’s liability coverage does not become UM coverage because the other motorist escaped. If the investigation instead reveals that both drivers contributed to the crash, potential liability claims must be reassessed.

What Happens If a Hit-and-Run Driver Hits Your Uber?

A hit-and-run does not necessarily leave an injured passenger without a claim. Report the collision promptly and preserve identifying evidence. Partial plate information, vehicle descriptions, debris, witnesses, dashcams, and nearby cameras may help locate the responsible motorist.

Coverage investigation and driver identification can proceed together. The Hollywood hit-and-run accident page explains the evidence and insurance issues in more detail. Any applicable policy notice requirements should be addressed promptly.

Who Can Be Held Liable for an Uber Accident in Florida?

The Uber driver, another motorist, or other parties may be responsible when their conduct and the applicable law support a claim. Negligent driving can include failing to yield, unsafe turns, following too closely, running a signal, or distraction. When both drivers contributed, each account should be tested against independent evidence and Florida’s comparative-fault rules.

Ownership and commercial relationships require a separate inquiry. An employer may be responsible for a driver acting within a qualifying work relationship. A maintenance provider may face a claim when negligent work caused the collision. Rental and fleet relationships can affect insurance, but a commercial rental company is not automatically liable merely because it owns the vehicle; federal protections and proof of its own negligence may matter.

These theories depend on facts. The investigation should identify who actually contributed to the injury rather than treating every entity associated with the vehicle as liable.

Can You Sue Uber Directly After an Uber Driver Causes an Accident in Florida?

A direct claim against Uber is not automatic merely because an Uber driver caused an accident. Florida law conditionally treats transportation-network-company drivers as independent contractors and provides substantial statutory protection to transportation network companies when statutory requirements are satisfied.

In Haddad v. Lyft Florida, Inc., the Florida Fourth District Court of Appeal interpreted section 627.748(18) broadly in a case involving direct claims against Lyft. That statutory framework must be considered when evaluating whether a direct claim against Uber is legally viable.

Statutory noncompliance, criminal wrongdoing, vehicle ownership or bailee status, and other particular facts may affect the analysis. A direct negligence theory should be based on supporting facts rather than simply alleging that Uber is responsible because its name appeared on the app.

Those statutory protections do not, however, eliminate a negligent driver's potential liability or reduce the insurance requirements Florida imposes during qualifying rideshare periods.

How Do Uber Pickup and Drop-Off Accidents Happen?

A negligent pickup, stop, or drop-off can injure a passenger or another road user without a conventional collision between moving vehicles. A driver may pull away before a passenger is safely seated or clear of the car. Stopping in an active traffic lane or requiring a passenger to cross moving traffic can create a different hazard. Opening a door into an approaching bicyclist or motorcyclist can cause another serious injury.

These mechanisms deserve investigation on their own facts. At airports, hotels, restaurants, bars, and entertainment venues, curb congestion and limited stopping space may affect what was reasonable. Messages, app instructions, lighting, sightlines, roadway layout, and witnesses can help establish what happened. For entry or exit injuries, the precise sequence also matters to the coverage analysis.

10 Things to Do After an Uber Accident in Florida

Get medical attention, report the accident, preserve your trip and scene evidence, and understand your injuries and coverage before signing a settlement. These steps help protect both your health and the information needed to investigate the claim. If you are unable to gather evidence safely, medical care comes first.

1. Get Medical Attention and Call 911 After an Uber Accident

Get medical help promptly and call 911 when emergency assistance is needed. Tell medical providers how the accident happened and describe your symptoms accurately. Some injuries become more apparent after the scene has cleared. Florida’s PIP initial-treatment deadline is generally 14 days, but that deadline is not a reason to delay necessary care.

2. Get the Uber Driver’s and Other Driver’s Information

Identify each driver and vehicle when you can safely do so. Save driver names, contact information, license plates, insurance information, and the identity of any known vehicle owner. Record which vehicle you occupied and who else was present. The car may be owned, leased, rented, or part of a fleet.

3. Screenshot Your Uber Trip, Receipt, Driver Profile, and Trip ID

Save the app information that connects you to the ride. Preserve the trip ID, receipt, driver’s name and profile, pickup location, destination, route, fare, and relevant messages. Save available timestamps, including acceptance information if it is visible to you. A passenger’s screenshots may not contain the complete driver-status history, which can require additional records.

4. Photograph and Video the Uber Accident Scene

Photograph the overall scene as well as the vehicle damage. Roadway layout, signals, debris, skid marks, lighting, weather, sightlines, and visible injuries may help explain the collision. Keep the original files. Do not put yourself in traffic or interfere with emergency responders to obtain a photograph.

5. Find Witnesses Who Saw the Uber Accident

Obtain the names and contact information of independent witnesses when possible. A witness may have seen a signal change, an unsafe turn, a distracted driver, or the events immediately before impact. Knowing what the witness actually observed is more useful than asking the witness to assign legal fault.

6. Identify Surveillance Cameras and Dashcam Video

Look for possible video sources promptly because footage may be overwritten. Nearby businesses, homes, parking facilities, other vehicles, and intersections may have cameras. Record the location and custodian where possible so a preservation request can be directed to the right person. A camera’s presence does not guarantee it recorded or retained the collision.

7. Report the Uber Accident Without Guessing About Fault

Describe what you observed accurately and avoid speculation. Do not guess about speed, injuries, or another driver’s actions when you do not know. Report the collision to law enforcement when required and through the Uber app as appropriate. An app report does not replace police reporting, required insurance notice, or evidence preservation.

8. Preserve Uber App, GPS, Message, and Trip Evidence

Keep original electronic information and avoid deleting relevant messages or ride records. Save emails, receipts, app communications, location information, and any dashcam recordings you possess. A lawyer can assess which additional records should be requested from Uber, the driver, insurers, or other custodians and whether formal preservation notices are needed.

9. Keep Medical Bills, Wage-Loss Records, and Insurance Correspondence

Save the records that document the injury’s financial and practical consequences. Treatment records, bills, work restrictions, missed-work dates, pay records, and insurance letters can support damages and coverage analysis. Keep track of claim numbers and adjuster contacts so correspondence can be connected to the correct policy.

10. Do Not Sign an Uber Settlement or Release Before Understanding Your Claim

A signed release can end a claim even if additional treatment becomes necessary. Evaluate an offer against your injuries, prognosis, lost income, future needs, available coverage, and the claims the release would resolve. An early payment should not be accepted simply because the insurer describes it as routine.

What Digital Evidence Can Prove an Uber Accident Claim?

Electronic records can help establish the trip’s timing, the driver’s conduct, and the sequence of the collision. A passenger’s receipt may confirm a ride without providing the complete driver-status history. Records held by Uber, the driver, camera owners, or other custodians may need separate requests.

Trip Records, GPS, and Driver-Passenger Communications

Acceptance, cancellation, location, and message records can connect the driver’s activity to the collision. Comparing their timestamps may resolve a coverage dispute or explain a pickup location and route change. GPS accuracy and detail must be evaluated before using the data to draw conclusions about speed or movement.

Can Uber App and Cellphone Activity Prove Distracted Driving?

Device activity can support a distraction claim when evidence connects its use to the moments before impact. Ride offers, navigation, communications, and other applications may be relevant. Having Uber or Lyft open does not itself prove that the driver looked at the screen or caused the crash. App records should be evaluated alongside video, witnesses, sightlines, and reaction time.

Video and Available Vehicle Data

Dashcam footage, surveillance, and retrievable vehicle data may independently establish movement, signals, braking, or impact conditions. Not every camera retained footage, and not every vehicle recorded useful crash data. Vehicles may be repaired or disposed of before inspection, while recordings may be overwritten. Early identification of the evidence and its custodian is therefore important.

Ownership, rental, maintenance, and insurance documents provide additional context. Medical and wage records serve a different purpose: establishing the injuries and losses caused by the collision.

What Compensation Can You Recover After an Uber Accident in Florida?

Recoverable damages may include supported medical expenses, lost income, reduced earning capacity, property damage, and qualifying noneconomic losses. The amount depends on liability, causation, the injuries, and the proof—not simply the available insurance limit.

Medical expenses can include hospital care, diagnostic testing, physician treatment, therapy, surgery, and medication. Future treatment requires medical support. Insurance payments and reimbursement obligations should be tracked when evaluating the client’s eventual recovery.

Lost-income claims require evidence of the work missed because of the injuries. Pay records, work restrictions, attendance information, and changed duties can help establish the loss. A lasting inability to perform the same work may require an assessment of reduced future earning ability.

Pain, suffering, disability, and loss of normal activities may be compensable when the applicable legal requirements are met. In covered motor-vehicle cases, Florida’s threshold generally requires a qualifying injury, which can include permanent injury, significant permanent loss of an important bodily function, significant permanent scarring or disfigurement, or death. Our Florida permanent-injury threshold article explains when noneconomic damages are available.

Property damage and other legally recoverable economic losses need documentation too. After a fatal collision, the survivors’ and estate’s damages are evaluated under Florida’s Wrongful Death Act through the personal representative’s action.

A $1 million policy does not make an injury claim worth $1 million. The limit describes coverage subject to its terms and potentially competing claims. Serious injuries may justify investigating other coverage or assets; less serious injuries do not acquire greater value merely because a passenger trip had been accepted.

How Dan Investigates and Builds an Uber Accident Case

Dan personally develops the evidence needed to prove responsibility, coverage, medical causation, and damages. The work follows the disputed issues and the client’s treatment rather than a fixed timetable.

Early Investigation and Preservation

The initial work identifies the relevant records, insurance documents, witnesses, and custodians before evidence disappears. Dan discusses the collision and records already available with the client, seeks additional documents when needed, and directs preservation requests to the appropriate sources. Vehicle inspection and expert involvement are considered when the issues warrant them.

Developing Fault, Medical Causation, and Damages

A claim must explain how the collision occurred and connect it to the injuries and losses. Dan tests the drivers’ accounts against physical and electronic evidence. He reviews medical history, treatment, work restrictions, income loss, and supported future limitations. Preexisting conditions and aggravation injuries require accurate disclosure and medical proof, especially when insurers dispute causation.

Negotiation, Litigation, and Trial Preparation

A demand should address the issues an insurer would contest in court. When the injuries and future needs can be reasonably evaluated, Dan presents the supporting evidence and negotiates with the responsible parties. He discusses material offers directly with the client. The client decides whether to accept a settlement.

If a fair resolution cannot be reached, Dan evaluates filing suit and prepares the case for court when warranted. Discovery, depositions, expert testimony, mediation, and trial preparation address the facts that must be proved. He handles the case personally through trial when necessary.

Why Clients Choose Daniel B. Reinfeld for Uber Accident Cases

Clients work directly with an attorney who brings prior insurance-defense experience and jury-trial experience to their claim. Dan has practiced law since 1999. Before representing injured people, he defended insurers and other defendants in civil litigation. That experience informs how he evaluates an insurer’s liability, causation, coverage, and damages arguments.

Dan obtained a $1.6 million unanimous jury verdict in a motor-vehicle case involving an injured pedestrian. TopVerdict recognized the result among Florida’s Top 100 Personal Injury Verdicts and Top 10 Pedestrian Accident Verdicts of 2024. The pedestrian accident practice page provides more information. Prior results do not guarantee a similar outcome.

For an Uber claim, the relevant work may include evaluating reaction time, sightlines, impact mechanics, disputed medical causation, and future limitations. Dan develops the case for negotiation and, when necessary, presentation in court. Clients speak with the lawyer responsible for that work.

Frequently Asked Questions About Uber Accidents, Rideshare Insurance, and Injury Claims in Florida

What should I do immediately after being injured as a passenger in an Uber accident in Florida?

Get medical attention, report the crash, and preserve your Uber trip information and scene evidence as soon as you safely can. Call 911 when appropriate, identify the drivers, obtain witness contacts, and photograph the scene. Save your trip receipt and relevant messages. If your injuries prevent you from gathering evidence, medical care comes first.

Does Uber's $1 million insurance policy mean my Uber accident case is worth $1 million?

No. Uber's $1 million liability limit does not mean an injured passenger automatically receives $1 million or that an Uber accident claim is worth $1 million. The value of a Florida rideshare injury claim depends on fault, the nature and permanence of the injuries, medical expenses, lost income, future treatment, available insurance, and other damages and evidence. The policy limit establishes a potential ceiling under that particular coverage, not the value of every claim.

Does Uber’s $1 million liability coverage apply before the passenger gets into the car?

Yes, Florida’s at-least-$1-million primary liability requirement applies once the Uber driver accepts a passenger’s ride request, including travel to the pickup before the passenger enters the vehicle. The prearranged ride ends when the last rider exits and no longer occupies the vehicle. Acceptance timestamps can help resolve disputes about whether this coverage period had begun.

What insurance applies if an Uber driver causes a crash while waiting for a ride request?

When an Uber driver is logged into the app but has not accepted a ride request, Florida requires primary liability coverage of at least $50,000 for death or bodily injury per person, $100,000 per incident, and $25,000 for property damage. This differs from the accepted-trip requirement. The driver’s app activity and applicable policies must be reviewed to establish coverage.

What information should an injured Uber passenger screenshot from the Uber app after an accident?

An injured Uber passenger should preserve the trip ID, receipt, driver's name and profile, pickup location, destination, route, fare information, and relevant driver-passenger messages. If possible, also preserve information showing when the ride was accepted and whether the driver was traveling to the pickup or transporting the passenger when the collision occurred. Original electronic records should be kept whenever possible.

Can I obtain Uber records showing whether the driver was logged into the app during the accident?

Yes, Florida law requires a transportation network company, upon request by a directly involved party during a claims coverage investigation, to provide the driver’s precise app login and logout times for the 12 hours before and after the accident. Additional trip, acceptance, GPS, and communication records may require separate requests or litigation discovery. These records can help establish which insurance period applied.

What happens if an Uber driver was using both Uber and Lyft when the accident happened?

Using multiple rideshare or delivery apps can create additional insurance and distraction issues that require examination of each app's status at the time of the collision. The investigation should determine which applications were active, whether a passenger request had been accepted, what the driver was doing immediately before impact, and which insurance policies potentially applied. Having multiple apps open does not, by itself, establish negligence.

Who pays an Uber passenger's medical bills after a rideshare accident in Florida?

Florida PIP is generally one of the first sources of medical benefits to investigate after an Uber passenger is injured. The passenger's own PIP policy or qualifying resident-relative coverage may follow the passenger into the Uber. If neither exists, coverage associated with the occupied rideshare vehicle may become relevant under Florida's priority rules. Health insurance and other available medical coverage can also affect how bills are paid while the liability claim is pending.

Can an Uber passenger receive Florida PIP benefits without owning a car?

Yes, an Uber passenger who does not own a car may still have potential PIP benefits depending on household insurance and Florida's statutory priority rules. A qualifying resident-relative policy may provide coverage, and when neither personal nor household PIP exists, coverage associated with the occupied Uber vehicle may become relevant. The person's residency and insurance relationships should be examined rather than assuming no PIP exists.

What happens when another driver hits an Uber but both insurance companies deny responsibility?

A dispute between drivers or insurance companies does not automatically defeat an injured Uber passenger's claim. The collision should be independently investigated using vehicle damage, photographs, witnesses, police evidence, video, GPS information, electronic data, and other available evidence. When more than one driver contributed to the crash, more than one liability policy may potentially be involved.

Can I recover compensation if I was partly at fault for an Uber accident in Florida?

Potentially. For claims governed by Florida’s modified comparative-fault rule, your damages are reduced by your percentage of fault. If you are found more than 50% responsible for your own harm, you cannot recover damages in the negligence action. An insurer’s accusation does not establish your legal responsibility; the crash evidence and applicable law must be evaluated. The percentage rule is established in § 768.81.

Can uninsured motorist coverage help when a hit-and-run driver or uninsured driver causes an Uber accident?

Yes, UM/UIM coverage may provide compensation after an Uber accident when the responsible driver flees, has no bodily-injury insurance, or has inadequate limits, but the available policies must be individually examined. Coverage may exist through the injured person's own policy or a qualifying resident-relative policy. Uber's liability coverage should not automatically be treated as UM coverage. Additional information is available on our Florida uninsured motorist coverage and Hollywood hit-and-run accident pages.

Does Uber automatically provide $1 million of uninsured motorist coverage to passengers in Florida?

No. Uber's $1 million liability requirement does not automatically create $1 million in UM/UIM coverage for an injured passenger. Liability and uninsured motorist coverage are legally distinct. The applicable rideshare policy, any UM rejection documents, the injured person's own insurance, resident-relative coverage, insured status, exclusions, and other facts should be reviewed before determining whether UM benefits are available.

Can an Uber driver recover compensation when another motorist causes the rideshare accident?

Yes. An Uber driver injured by another negligent motorist can pursue compensation from the at-fault driver and potentially other applicable insurance. The investigation may include the responsible driver's bodily-injury liability coverage, Florida PIP benefits, the Uber driver's personal UM/UIM insurance, and other available policies. Uber's liability policy does not automatically compensate its driver for the driver's own injuries.

Can you sue Uber if Uber says the rideshare driver is an independent contractor?

A direct claim against Uber is not automatically established by an Uber driver's negligence, but independent-contractor status does not eliminate the injured person's claim against the negligent driver or applicable insurance. Florida's transportation-network-company statute provides substantial protection to TNCs when specified statutory requirements are satisfied. A direct claim against Uber therefore requires analysis of the actual facts and applicable statutory provisions.

Can I make an Uber injury claim if I was hurt while getting into or out of the vehicle?

Potentially. A claim may arise when negligent driving, stopping, or passenger unloading causes an injury—for example, when a driver pulls away before a passenger has safely exited. Who caused the injury and the precise sequence of events determine which claims and insurance should be investigated. Preserve the trip record, messages, photographs, and witness information.

Can Uber app use prove distracted driving after a rideshare accident?

Uber app activity can support a distracted-driving claim when electronic evidence connects the driver's app or cellphone use to the moments before the crash. Relevant evidence may include app-event records, cellphone activity, ride offers, GPS data, navigation activity, witness testimony, dashcam footage, and other electronic records. Merely having the Uber app running does not automatically prove that the driver was negligent.

Can I recover compensation after an Uber accident if I had a prior neck or back injury?

Yes. A prior neck, back, or other medical condition does not automatically prevent recovery when an Uber accident causes a new injury or aggravates a preexisting condition. Medical evidence may be necessary to distinguish the effects of the new collision from prior symptoms and treatment. Accurate disclosure of the prior medical history is important because insurers frequently examine earlier records when causation is disputed.

Can I recover lost wages and pain and suffering after an Uber accident in Florida?

Yes, supported lost income and other economic damages may be recoverable, while pain-and-suffering damages generally require satisfaction of Florida's motor-vehicle injury threshold. Wage records, medical work restrictions, attendance records, tax information when appropriate, and evidence of reduced duties can help establish income loss. Our discussion of Florida's car accident permanent-injury threshold explains when noneconomic damages may be available.

Should I accept a quick settlement offer from Uber's insurance company after an accident?

Do not accept an early Uber accident settlement before understanding the injuries, available insurance, and legal effect of the release. A signed settlement can permanently resolve a claim even when additional treatment or future limitations later become apparent. An offer should be evaluated against the medical evidence, prognosis, lost income, future needs, applicable insurance limits, and other recoverable damages.

How long does an Uber accident injury claim take to settle in Florida?

There is no single timetable for settling a Florida Uber accident claim because the length of the case depends on the injuries, medical treatment, disputed liability, insurance issues, and whether litigation becomes necessary. Some claims can resolve through negotiation after the injuries and damages are reasonably understood. Contested cases may require a lawsuit, written discovery, depositions, expert testimony, mediation, and potentially trial.

How long do I have to file an Uber accident lawsuit in Florida?

Many Florida negligence claims arising from accidents on or after March 24, 2023 are subject to a two-year statute of limitations, but the correct deadline must be determined from the particular claim and facts. Wrongful-death actions, governmental claims, insurance disputes, accidents predating the statutory change, and other circumstances can involve different rules. Negotiating with an insurance company should not be assumed to stop a filing deadline.
