Rideshare Accident Attorneys in Hollywood, FL with Proven Trial Experience

$1.6 Million Motor-Vehicle Jury Verdict | 25+ Years in Practice | Former Insurance-Defense Attorney

A rideshare injury claim requires identifying who caused the accident, the driver’s app status, and the available insurance. A driver waiting for a request is in a different coverage period from one traveling to an accepted pickup. Passengers, rideshare drivers, and people struck outside the vehicle may have different claims and benefits. Our rideshare injury lawyer compares the crash evidence with trip acceptance, cancellation, location, and other available records. We examine personal and commercial insurance, document the injuries and financial losses, and prepare the claim for negotiation or litigation. A company’s name on the app does not establish which party is liable or which insurer must pay. Dan personally handles each accepted case from consultation through settlement or trial. With more than 25 years of practice and former insurance-defense experience, Dan understands how insurers evaluate and contest injury claims. For company-specific information, read our Hollywood Uber accident lawyer guide and Hollywood Lyft accident lawyer guide. Our broader Hollywood car accident lawyer page addresses other motor-vehicle injury claims.

Who Can Pursue Compensation After a Rideshare Accident

Injured Rideshare Passengers

A passenger may have a claim against the rideshare driver, another motorist, or multiple responsible parties. When drivers blame each other, the passenger's claim should be developed through independent evidence rather than relying on either insurer's account. Personal or household insurance may also provide benefits, depending on the policy and the passenger's circumstances.

Motorists, Pedestrians, and Bicyclists Hit by Rideshare Vehicles

You do not have to book a ride to pursue a negligent rideshare driver. Other motorists, pedestrians, bicyclists, and motorcyclists may be injured by unsafe turns, failure to yield, distracted driving, or improper stopping. App status remains relevant to coverage even when the injured person was outside the vehicle. Our Hollywood pedestrian accident guide addresses crossing and visibility issues. Our motorcycle accident page explains distinct PIP and injury-threshold questions.

Rideshare Drivers Injured by Another Motorist

A rideshare driver injured by another negligent motorist can pursue that motorist and potentially applicable insurance, including PIP and UM/UIM where available. The rideshare company’s liability policy does not automatically pay its own driver for injuries caused by someone else.

Families After a Fatal Rideshare Accident

When a rideshare collision causes a death, Florida's Wrongful Death Act governs the claim, which is brought by the estate's personal representative on behalf of the survivors and the estate. The recoverable damages depend on the family relationships and circumstances. These cases require coordinating the crash and coverage investigation with the estate proceedings.

Injuries During Passenger Pickup and Drop-Off

An injury may occur when a driver pulls away before a passenger safely enters or exits, stops unsafely, or opens a door into a bicyclist or motorcyclist. Trip acceptance, cancellation, vehicle position, and whether the last passenger had fully exited can affect the claim. Preserve messages, the receipt, photographs, and witness information.

Florida Rideshare Insurance Requirements by Driver Status

Florida rideshare insurance coverage depends on the driver’s app and ride status. For human-driven transportation network company (TNC) trips, the following liability minimums apply. A prearranged ride begins when the driver accepts the request, includes travel to the pickup, and ends when the last passenger exits and no longer occupies the vehicle. The requirements are established in Fla. Stat. § 627.748.

App off. Personal automobile insurance and any applicable commercial, fleet, or rental coverage. The statutory TNC requirements do not apply merely because the person sometimes drives for an app.

Logged on and waiting, no accepted ride. At least $50,000 for bodily injury or death per person, $100,000 per incident, and $25,000 for property damage, with separate PIP and UM/UIM requirements discussed below.

Ride accepted and traveling to pickup. At least $1 million in primary liability coverage for death, bodily injury, and property damage, with separate PIP and UM/UIM requirements discussed below.

Passenger aboard during the accepted ride. The same at-least-$1-million primary liability requirement continues until the last rider exits and no longer occupies the vehicle.

These are statutory minimum liability requirements, not guaranteed payments or valuations of an injury claim. Section 627.748 separately addresses PIP, including a limousine-related standard during accepted rides, and UM/UIM as required by section 627.727. Benefits depend on the applicable law, actual policies, insured status, and any valid rejection or exclusion. A $1 million liability requirement does not establish $1 million in uninsured motorist coverage.

Transportation network company insurance requirements may be satisfied through driver or vehicle-owner coverage, TNC coverage, or a combination. If the driver's required coverage has lapsed or does not provide the required coverage, the TNC's insurance must supply it from the first dollar of the claim and must defend the claim. TNC coverage cannot depend on a personal insurer first denying the claim.

A driver’s personal auto policy may exclude rideshare use during the logged-on and accepted-trip periods. Under the statute, those exclusions do not diminish coverage otherwise available to resident relatives or permissive drivers who were not occupying the TNC vehicle at the time of loss. A denial under the driver’s personal policy does not, alone, resolve the other coverage questions.

Medical Bills, PIP, and Uninsured Motorist Claims

Personal injury protection (PIP), part of Florida’s no-fault insurance system, may provide initial medical benefits through the injured person’s own policy or qualifying household coverage. If neither exists, coverage associated with the occupied vehicle may apply under Florida’s priority rules. Residency, insurance relationships, and the applicable TNC requirements need review.

Under Fla. Stat. § 627.736, ordinary PIP generally pays 80% of covered medical expenses and 60% of covered income loss, subject to a combined $10,000 medical-and-disability limit, applicable deductibles, exclusions, and other limitations. Medical benefits require qualifying initial services within 14 days. Access to the full medical limit requires an emergency-medical-condition determination by a qualifying provider; the statute limits medical reimbursement to $2,500 when an authorized provider determines that no emergency medical condition existed. A missing or disputed determination requires separate review. Missing the PIP medical-treatment deadline does not automatically extinguish a negligence claim.

When an uninsured, underinsured, or hit-and-run driver causes the collision, UM/UIM may provide another source of recovery. Examine the actual policies rather than assuming the rideshare liability policy supplies those benefits. Our Florida uninsured motorist guide explains related coverage questions.

In Progressive Express Insurance Co. v. Monasterio, No. 24-11256 (11th Cir. Nov. 18, 2024), an unpublished decision involving an Uber driver, the court found that the policy did not specifically insure identified vehicles and that the named insured had also rejected UM coverage in writing. It therefore held that Florida law did not require UM coverage under that policy. The ruling does not establish the terms of every rideshare policy.

Rideshare Hit-and-Run Accidents

If another motorist hits your Uber or Lyft and flees, report the crash promptly and preserve any partial plate, vehicle description, debris, dashcam recording, and nearby camera locations. If the rideshare driver was not at fault, the rideshare liability policy is not a substitute for the fleeing driver's insurance, which makes UM coverage and its notice requirements especially important. Our hit-and-run accident page explains these evidence and insurance questions.

Who Is Liable for a Florida Rideshare Accident?

A claim may proceed against a negligent driver and applicable insurance, while liability against the rideshare company requires a separate analysis. Fla. Stat. § 627.748(18) protects a qualifying TNC against specified harm arising from a TNC vehicle’s use while the driver is logged on when the company committed no negligence under that section or qualifying criminal wrongdoing, fulfilled its statutory obligations regarding the driver, and was neither owner nor bailee of the vehicle. Subsection (9) separately establishes independent-contractor status when its conditions are met.

Two Florida appellate decisions illustrate the limits on company claims. In Abner v. Lyft Florida, Inc., 422 So. 3d 1226 (Fla. 3d DCA 2025), No. 3D24-0479 (Oct. 22, 2025), the court affirmed summary judgment for Lyft after a collision injured a motorcyclist. It found independent-contractor status and insufficient evidence supporting negligent hiring or retention, including no statutory disqualification based on the cited driving history. It left broader questions about the existence and scope of a common-law hiring claim for another case.

In Haddad v. Lyft Florida, Inc., No. 4D2025-0117 (Fla. 4th DCA May 13, 2026), the court affirmed dismissal of negligent and fraudulent misrepresentation claims arising from an alleged assault by a driver. It interpreted subsection (18) broadly rather than limiting it to traditional vicarious liability. The Fourth District is the appellate district that includes Broward County and Hollywood. These decisions do not eliminate a claim against a negligent driver or reduce the statute’s insurance requirements. Whether company liability exists depends on statutory compliance, company conduct, ownership or bailment, and the pleaded facts. Failure to qualify for statutory protection does not, by itself, prove liability.

Hollywood Rideshare Pickups and Drop-Offs Require Local Investigation

The pickup pin, destination, and actual injury location can differ. We investigate where the driver stopped, traffic movement, passenger instructions, and available witnesses or cameras.

Hollywood Beach Broadwalk and A1A

For pickups near Hollywood Beach, hotels, and A1A, preserve the address, entrance, loading area, and meeting-point messages. The Broadwalk is a pedestrian destination; the vehicle pickup may occur on a nearby street or property. A turn, door opening, or passenger unloading requires investigation of the actual movements.

Downtown Hollywood, Young Circle, and Hollywood Boulevard

For pickups near Young Circle, Hollywood Boulevard, restaurants, and entertainment venues, identify whether the vehicle stopped in a travel lane, parking space, driveway, or loading area. Business video, dashcams, and witnesses may distinguish a properly stopped vehicle from a hazardous maneuver.

FLL, Port Everglades, and Seminole Hard Rock Trips

Hollywood residents and visitors use rideshare vehicles for trips involving Fort Lauderdale-Hollywood International Airport, Port Everglades, and Seminole Hard Rock Hotel & Casino Hollywood. Save pickup instructions, terminal or entrance information, and trip changes. These destinations serve the wider area; the collision may occur in Hollywood, another municipality, or on a connecting roadway such as I-95, US-1, or Sheridan Street. The actual location determines which scene evidence and investigating agency to identify. Our Hollywood guides explain how to obtain a Hollywood police report, 911 recording, and Ring, Nextdoor, and surveillance footage.

Rideshare Services Beyond Uber and Lyft

Florida's TNC framework is based on how a service operates, rather than being limited to two brand names. Other passenger services can raise related claims, although their legal classifications and insurance are not interchangeable.

Waymo and Autonomous Ride-Hailing

Driverless rides involve a separate statutory insurance provision. Under Fla. Stat. § 316.85, on-demand autonomous vehicle networks operate under TNC laws, except for provisions that reasonably apply only to human drivers. Fla. Stat. § 627.749 requires at least $1 million in primary liability coverage when the automated driving system is engaged while the vehicle is logged onto the network or engaged in a prearranged ride.

Investigating an autonomous vehicle may require records concerning its automated driving system, vehicle operation, ownership, and maintenance. Our Florida Waymo classification article and Waymo PIP and injury-threshold discussionexamine those distinct issues.

App-Booked Black Cars and Luxury Transportation

Section 627.748(16) recognizes luxury ground TNCs that connect riders exclusively to drivers of for-hire vehicles such as limousines and luxury sedans. A company becomes a luxury ground TNC only by electing that status through written notice to the state, so a limousine company's use of an app does not by itself establish the classification. The booking arrangement, operator, vehicle, regulatory status, and insurance should be examined before applying the coverage periods above.

Hollywood Sun Shuttle by Circuit and Holly-Go

Hollywood’s Sun Shuttle by Circuit is an app-booked, on-demand electric shuttle. The city also offers the separate Holly-Go community shuttle. Injured passengers should preserve the vehicle identity, operator, booking record, route, and location. App booking does not establish that ordinary TNC insurance rules apply. Operator responsibility, employment relationships, and governmental involvement require individual review. Claims against a governmental entity may involve notice requirements and recovery limits under Fla. Stat. § 768.28.

Taxis, Carpools, and Medical Transportation

Section 627.748 excludes taxicabs, street hails, carpools, and arrangements where the driver receives no more than the cost of the ride. It also excludes companies that arrange Medicaid or Medicare transportation under state or managed-care contracts, while still permitting a qualifying TNC to give rides to eligible beneficiaries. A free ride to the passenger does not, alone, resolve classification; the driver's compensation and operating arrangement matter. Our Hollywood taxi accident attorney page addresses taxicab claims.

Food and Grocery Delivery Accidents Are Related but Different

DoorDash, Grubhub, Uber Eats, and Instacart delivery crashes involve app-based work, but transporting an order is different from providing a passenger's prearranged ride. The coverage periods above should not automatically be applied to a food or grocery delivery accident.

A food delivery accident claim requires identifying the platform, driver, vehicle owner, delivery stage, and applicable policies. Personal-policy business-use exclusions and platform coverage need review. If passenger and delivery apps were active together, preserve each app’s records. Amazon Flex and Delivery Service Partner claims are addressed in our Amazon delivery accident guide.

Evidence That Can Resolve a Rideshare Coverage Dispute

The most useful records connect the collision to the driver's activity at that exact time. Preserve available originals as well as screenshots, including:

Trip ID, receipt, driver profile, vehicle information, and booking account; acceptance, cancellation, pickup, and drop-off records and timestamps; messages identifying where the passenger and driver would meet; photographs, dashcam recordings, nearby surveillance, and witness contacts; crash-report details, vehicle damage, medical records, and work restrictions; and activity from other passenger or delivery apps used during the trip.

In a claims coverage investigation, Florida's TNC statute requires the company, upon request by a directly involved party or the driver's insurer, to provide the precise times the driver logged on and off in the 12 hours before and after the accident. TNCs must also keep individual ride records for at least one year. Additional trip, GPS, or cellphone records may require separate requests or litigation discovery. A trip receipt alone may not resolve whether a request had been accepted before impact.

Can App and Cellphone Records Prove Distracted Driving?

Phone activity may support a distraction claim when it can be tied to the moments before impact, such as ride offers, navigation, or messages about a pickup. Having an app open does not prove the driver looked at the screen or caused the crash. We compare device records with video, witness observations, reaction time, sightlines, and vehicle movement. Navigation app activity and driver fatigue may also warrant investigation, including available trip history, driving hours, and evidence of the driver’s attention before impact.

Compensation and Deadlines for Hollywood Rideshare Injury Claims

Compensation may include supported medical expenses, future care, lost income, reduced earning capacity, and other recoverable damages. Pain, suffering, mental anguish, and inconvenience generally require meeting the applicable motor-vehicle injury threshold when Fla. Stat. § 627.737 applies, such as a permanent injury within a reasonable degree of medical probability or significant permanent scarring. Rideshare crashes can cause fractures, traumatic brain injuries, spinal injuries, and aggravation of prior neck or back conditions. Medical evidence should address causation, permanence, and future needs.

For negligence claims governed by Fla. Stat. § 768.81, compensation is reduced by the injured person's percentage of fault, and a person found more than 50% responsible for their own harm cannot recover. An insurer's accusation does not establish that percentage.

Many negligence claims involving accidents on or after March 24, 2023 have a two-year filing period under Fla. Stat. § 95.11. Claim type, accident date, exceptions, and governmental notice requirements can change the analysis. Reporting a crash through an app or negotiating with an insurer does not preserve the filing deadline.

Hollywood Rideshare Accident Lawyer Frequently Asked Questions

Do I need a ridesharing accident lawyer if I was a passenger?

A lawyer can help when fault, coverage, or the extent of your injuries is disputed. Passengers may face competing insurers even though they did not control either vehicle. Your consultation can identify the responsible parties, available policies, and records needed to support the claim.

Can I bring a claim if I was hit by a rideshare car but never booked a ride?

Yes. A motorist, pedestrian, or bicyclist may pursue a negligent rideshare driver without having booked a trip. The driver's app status can affect available insurance, while fault and injury causation must still be established.

Does rideshare insurance apply before the passenger enters the vehicle?

Yes. For qualifying human-driven TNC trips, Florida's at-least-$1-million liability requirement begins when the driver accepts the passenger request, including travel to pickup. Preserve the acceptance and cancellation records when the timing is disputed.

Is my rideshare injury case worth one million dollars?

Not automatically. A liability limit identifies potentially available coverage, not the value of your claim. Fault, injuries, medical evidence, lost income, future needs, other damages, and competing claims can affect the recovery.

What if the driver was running Uber, Lyft, and a delivery app together?

Each app's status and applicable policy should be investigated. Determine which request was accepted and what the driver was doing at impact. Multiple apps may create coverage or distraction questions, but having them open does not itself establish negligence.

Can I sue the rideshare company itself?

Potentially, but Florida law substantially limits direct claims against rideshare companies. Statutory compliance, company conduct, ownership or bailment, and the particular allegations determine whether a claim can proceed. Claims against a negligent driver and potentially applicable insurance must be evaluated separately.

Can an injured rideshare driver recover lost income?

Yes, supported income losses may be recoverable from a responsible party. Preserve platform earnings statements, expenses, tax records when relevant, and medical restrictions. Gross app receipts alone may not establish the driver's actual loss.

What if I was hurt getting into or out of a rideshare vehicle?

A claim may arise from negligent stopping, door operation, or pulling away before you safely exit. The exact movements and trip status determine which parties and policies to investigate. Preserve the pickup messages and identify witnesses or cameras.

Are delivery drivers covered by the same rideshare insurance rules?

Not automatically. A food or grocery delivery is different from a passenger's prearranged ride. Delivery status, platform terms, and the actual insurance policies need review before determining available coverage.

Does a rideshare driver qualify for workers' compensation?

Usually not. Under § 627.748(9), a driver is an independent contractor rather than an employee if the company does not set required hours, does not bar other platforms or other work, and has a written independent-contractor agreement. That status does not eliminate a negligence claim against another motorist, and any occupational accident coverage needs separate review. Our Hollywood workers' compensation lawyer page covers employee injury claims.

Can I get PIP benefits if I do not own a car?

Possibly. Qualifying household coverage or coverage associated with the occupied vehicle may apply under Florida's priority rules. Residency and insurance relationships should be reviewed before concluding that no benefits are available.

Should I give the rideshare insurer a recorded statement?

Obligations differ between a claim under your own policy and dealings with another party's insurer. Before giving a recorded statement, identify the insurer, policy, and reason for the request. Report accurately and comply with applicable notice and cooperation obligations; do not guess about facts you do not know.

Can a Hollywood rideshare accident attorney help an out-of-state visitor?

Yes. Our firm represents people injured in Hollywood even if they live elsewhere. Florida accident evidence and applicable coverage can be investigated while coordinating medical documentation from the visitor's home state. Residence alone does not determine the governing insurance rules.

How long does a rideshare accident claim take?

There is no fixed settlement timetable. Treatment, prognosis, disputed fault, insurance issues, and litigation affect the process. A claim should be evaluated using the supported injuries and future needs before accepting a release that may permanently resolve it.

How much does a Hollywood ride share accident lawyer cost?

The consultation with Daniel B Reinfeld, PA is free. Injury representation is handled under a written contingency-fee agreement, with no attorney's fee unless compensation is recovered. The agreement explains the fee percentage and treatment of case costs.

How do I choose a rideshare accident lawyer near me?

Look for a Florida rideshare accident attorney who explains the applicable insurance, preserves trip records, and personally develops the injury claim. Ask who will handle your case, whether the attorney has trial experience, and how fees and case costs work. Our Hollywood office offers direct consultations with Dan.

Where can I meet with your Hollywood rideshare accident attorney?
