$1.6 Million Motor-Vehicle Jury Verdict | 25+ Years in Practice | Former Insurance-Defense Attorney

You may appear the same after an accident but struggle to remember conversations, concentrate at work, or manage tasks that once came easily. A concussion or traumatic brain injury can affect your ability to earn a living, maintain relationships, and live independently. Proving a brain injury claim means showing how the accident caused those changes—and what they mean for your future. At Daniel B Reinfeld, PA, our firm builds the claim around the medical evidence and its impact on your daily life. Dan personally handles each accepted case from consultation through settlement or trial, pursuing compensation for medical expenses, lost income, pain and suffering, permanent impairment, and future care. With more than 25 years of litigation experience and a former insurance-defense background, he understands how insurers challenge serious injury claims and how to prepare the evidence needed to answer those challenges.

Brain Injury Claims at a Glance
-
A concussion is a traumatic brain injury. A normal CT scan does not, by itself, rule out a concussion.
-
A claim requires evidence connecting another party's legal responsibility to the injury and resulting losses.
-
The medical diagnosis, effect on daily life, future needs, available coverage, and disputed fault all matter when evaluating compensation.
-
Florida negligence lawsuits generally have a two-year filing deadline. Other claims and special circumstances can follow different rules.
Suspected Brain Injury and Emergency Warning Signs
Call 911 or seek emergency care immediately after a head injury if there is a worsening headache, repeated vomiting, seizure, weakness, slurred speech, increasing confusion, unequal pupils, or difficulty waking the injured person. Legal questions can wait while emergency treatment is obtained. The CDC identifies these as brain injury danger signs. For nonemergency symptoms, obtain prompt medical evaluation and follow the treating clinician's instructions. Tell the provider about changes in memory, concentration, sleep, mood, balance, and vision, even when the person looks physically uninjured.
Hollywood Brain Injury Claims: Attorneys Credentials and Recognition

Reinfeld is AV Preeminent® 5.0 out of 5 Peer Review Rated by Martindale-Hubbell and holds Avvo’s highest attorney rating, 10.0 “Superb.” Dan obtained a $1.6 million unanimous jury verdict in a motor-vehicle case involving an injured pedestrian, included in TopVerdict’s Top 100 Verdicts in Florida for 2024. He is a Life Member of the Million Dollar Advocates Forum and Multi-Million Dollar Advocates Forum, whose membership is limited to attorneys who served as lead counsel in qualifying million- and multimillion-dollar verdicts or settlements. These credentials reflect Dan’s broader trial and injury practice. For other selected matters, review jury verdicts and settlements. Every recovery depends on the facts, law, evidence, and insurance coverage; past results do not guarantee a similar outcome.

What Is a Traumatic Brain Injury
A traumatic brain injury is an injury affecting brain function caused by an external force, such as a blow, jolt, penetrating injury, or rapid movement of the brain within the skull. A head injury can involve the scalp or skull without an established TBI; a qualified clinician must evaluate whether the brain itself was injured. A concussion is a form of mild TBI, and the word mild does not mean the symptoms are unimportant.
The National Institute of Neurological Disorders and Stroke describes injuries that range from concussion to severe brain trauma. Classification and prognosis depend on the clinical evidence, rather than a lawyer's description of the accident.
Concussion and Mild Traumatic Brain Injury
A concussion may occur without a direct head strike or loss of consciousness. Some people develop persistent symptoms that interfere with work, school, or ordinary activities. The CDC explains that concussion may be present even when imaging does not show the injury. The medical evaluation and recovery history remain important evidence.
Moderate and Severe TBI and Closed Head Injuries
A closed head injury occurs without an object penetrating the skull into the brain. Depending on the findings, traumatic brain injuries may involve contusions, intracranial bleeding, swelling, or diffuse axonal injury. Diffuse axonal injury involves damage to nerve fibers and can occur with forceful rotational movement or sudden stopping. These terms describe different aspects of injury and should not be treated as interchangeable diagnoses. Specialists determine the diagnosis and expected consequences.
Oxygen Deprivation and Acquired Brain Injury
Acquired brain injury is a broader term that includes traumatic and nontraumatic causes. Hypoxic brain injury involves inadequate oxygen; anoxic injury involves an absence of oxygen. Near-drowning and some other incidents may involve oxygen-deprivation injuries rather than TBI alone. The injury mechanism, responsible parties, and appropriate legal claim require individual evaluation.
Accidents That Can Cause Brain Injuries in Hollywood
Our firm evaluates head and brain injury claims arising from:
-
Car and truck accidents: Rear-end, side-impact, head-on, rollover, and other crashes may involve direct impact or rapid head movement. Our Hollywood car accident lawyer page explains the underlying collision claim.
-
Motorcycle, bicycle, and pedestrian collisions: A rider or pedestrian may sustain head trauma from a vehicle impact or a subsequent fall. See our Hollywood motorcycle accident claims and pedestrian accident representation.
-
E-bike and e-scooter accidents: Riders and pedestrians may suffer brain injuries in collisions involving motor vehicles or electric rideables. Read about Hollywood e-bike accident claims.
-
Slip and fall and trip and fall accidents: Wet floors, unsafe stairs, uneven walking surfaces, and other hazards may lead to a head strike. The property owner's responsibility must be established under the law applicable to the condition. See our Hollywood slip and fall lawyer page.
-
Workplace and construction accidents: Falling objects, equipment incidents, and falls may require evaluation of workers' compensation benefits and any available claim against a responsible third party.
-
Other preventable incidents: Falling merchandise, negligent-security incidents, and pool accidents may require different evidence and liability analysis.
We investigate incidents on Hollywood Boulevard, Sheridan Street, US 1, I-95, near Hollywood Beach, and at local businesses. The location and circumstances guide requests for surveillance footage, witnesses, roadway evidence, and property records.
Symptoms and Lasting Effects of a Brain Injury
Brain injury symptoms may affect physical function, thinking, emotions, and sleep. They can appear immediately or become noticeable over hours or days. The CDC's symptom guidance includes headaches, dizziness, light or noise sensitivity, memory and concentration problems, irritability, and sleep changes.
For a legal claim, the practical consequences matter: needing help managing medication, losing track of assignments, making errors at work, or being unable to tolerate activities previously performed comfortably. Family members may notice changes the injured person has difficulty describing. Record specific observations and dates, and discuss them with the treating provider.
Many people improve after a concussion, while some experience prolonged symptoms. More serious injuries may require substantial rehabilitation and support. Treatment, work restrictions, driving, and return to activity should follow medical guidance. The CDC provides information on recovery and persistent post-concussion symptoms.
How We Prove a Concussion or TBI Claim
A brain injury lawsuit requires proof of legal responsibility, causation, and damages. We examine who caused the incident, whether the evidence connects it to the injury, and how the injury affected the person's life. No single scan, symptom, or expert opinion automatically answers every question.
Preserve the Evidence of How the Injury Happened
Depending on the incident, relevant evidence may include police or incident reports, 911 records, photographs, witness accounts, surveillance recordings, vehicle data, damaged equipment, maintenance records, and inspection documents. Video and electronic information can be overwritten. Early preservation requests can be important even before the full medical picture is known.
When injury mechanics are disputed, a qualified reconstruction or biomechanics expert may help explain the forces involved. That analysis must stay within the expert's qualifications and be evaluated alongside clinical evidence; an accident animation is not a medical diagnosis.
Connect the Medical Findings to the Incident
We review emergency records, reported confusion or amnesia, neurological examinations, imaging when obtained, follow-up care, and rehabilitation records. When appropriate, neuropsychological evaluation may help assess memory, attention, processing speed, and other functions. Medical professionals must interpret results in light of the person's history and other possible explanations.
A normal scan should not end the investigation of a suspected concussion. Equally, a symptom report does not establish accident causation by itself. The chronology, medical assessment, prior condition, and functional evidence should be considered together.
Show What Changed at Home and at Work
Useful evidence can include employment records, reduced hours, work restrictions, school accommodations, and testimony from people who knew the injured person before the event. A short, factual diary can document missed tasks, assistance needed, and symptoms reported to providers. Accurate descriptions are more useful than generalized claims that everything changed.
Document Future Needs With Qualified Experts
When supported by the medical prognosis, a claim may require a life-care planner, vocational expert, or economist. Their work can help explain anticipated treatment, assistance, work limitations, and future financial losses. Projections should reflect supported needs, reasonable costs, and the applicable Florida damages rules.
Compensation in a Florida Brain Injury Case
Depending on the evidence and applicable law, recoverable damages may include:
-
Reasonable and necessary medical expenses, rehabilitation, medication, and future treatment.
-
Lost earnings and diminished future earning capacity.
-
Necessary assistance, attendant care, and other supported expenses attributable to the injury.
-
Pain and suffering, disability, mental anguish, and loss of enjoyment of life when legally recoverable.
The amount billed is not automatically the amount recoverable. Florida Statutes section 768.0427 governs evidence and recovery of medical expenses, including important rules concerning paid bills, unpaid charges, future care, and letters of protection.
What Is a Brain Injury Settlement Worth
There is no reliable settlement figure based only on a concussion or TBI diagnosis. We evaluate the medical evidence, lasting limitations, future needs, lost earning capacity, liability disputes, available insurance, and collectibility. A settlement should be assessed against the supported losses and litigation risks. A result obtained for another person cannot establish the value of your claim.
Florida Laws and Insurance Rules That Affect Brain Injury Claims
Filing Deadlines for a Hollywood Brain Injury Lawsuit
Florida Statutes section 95.11 generally provides two years for negligence actions. The incident date, claim type, defendant, and other facts can change the analysis. Government-related claims may require separate notice procedures. Do not assume delayed diagnosis or continuing treatment extends the filing deadline.
Comparative Fault
Under Florida Statutes section 768.81, a claimant's share of fault generally reduces damages. In a negligence action governed by the modified comparative-fault rule, a person found more than 50 percent responsible for their own harm cannot recover damages. At exactly 50 percent, the rule does not bar recovery, but damages are reduced. Applicability must be assessed for the particular claim.
PIP and the Serious Injury Threshold After a Motor Vehicle Crash
When Florida PIP applies, section 627.736 requires qualifying initial medical services within 14 days for medical-benefit eligibility. Missing that requirement can affect PIP benefits; it does not automatically eliminate a separate negligence claim.
For claims subject to section 627.737, pain-and-suffering damages require a qualifying injury, such as permanent injury within a reasonable degree of medical probability or significant and permanent loss of an important bodily function. A concussion diagnosis alone does not establish that threshold. These automobile rules do not apply identically to every brain injury case.
Uninsured and Underinsured Motorist Coverage
UM/UIM coverage may provide a source of recovery when a responsible driver has no applicable bodily-injury coverage or insufficient coverage. Entitlement depends on the policy, insured status, damages, and legal requirements. Before signing a release, evaluate any effect on a potential UM claim. Read about Hollywood uninsured motorist claims.
How Insurers May Dispute a Brain Injury Claim
Disputes may involve a normal scan, an early medical record that does not mention a head injury, prior headaches or concussions, gaps in treatment, or the injured person's ability to continue working. Each issue requires an evidence-based response. We examine the actual records and circumstances, identify what they establish, and obtain qualified opinions when needed.
Continuing to work does not, by itself, resolve whether a person has sustained an injury or lost earning capacity. Reduced productivity, accommodations, shortened hours, and assistance from coworkers can be relevant. Treatment gaps should be explained accurately rather than ignored. We prepare clients for insurer examinations and testimony while keeping medical decisions with their treating providers.
What to Do After a Suspected Brain Injury
1. Obtain medical attention and follow emergency and discharge instructions.
2. Report developing symptoms to your healthcare provider and ask for guidance about work, driving, and other activities.
3. Save incident information, photographs, witness details, and insurance correspondence. Preserve damaged helmets or equipment without altering them.
4. Keep a factual record of treatment, missed work, assistance needed, and changes observed by family members.
5. Obtain legal advice before signing a settlement release or giving a detailed recorded statement to the opposing insurer. Your own insurance policy may impose cooperation duties that should be addressed promptly.
Hollywood Brain Injury Treatment and Family Resources
Memorial Regional Hospital in Hollywood, at 3501 Johnson Street, identifies itself as a Level I Trauma Center treating serious injuries, including traumatic brain injuries. Memorial Rehabilitation Institute provides brain injury rehabilitation services, including physical, occupational, and speech therapies and neuropsychology services. These are independent community resources; their inclusion does not imply an affiliation with our firm.
Care needs differ. Families can ask the treating team about rehabilitation, caregiver education, and appropriate follow-up. A family member may contact our firm for an initial discussion, but authority to make legal decisions for the injured person must be established when required.
Hollywood Brain Injury Lawyer FAQs
Can I Bring a Concussion Claim Without Losing Consciousness
Yes, potentially. Loss of consciousness is not required for every concussion. A clinician must assess the injury, and the legal claim must establish fault, causation, and damages. Tell the provider about confusion, memory gaps, or other symptoms even if you remained awake.
Can a Brain Injury Occur Without Hitting Your Head?
Yes. Rapid acceleration, deceleration, or rotation of the head can injure the brain without a direct head strike. When the injury mechanism is disputed, a qualified biomechanical expert may help explain the forces involved. That analysis is considered alongside medical records, clinical findings, and other evidence connecting the incident to the injury.
Can I Have a Brain Injury Case if My CT Scan Was Normal
Yes, potentially. Normal CT findings do not rule out every concussion. Whether a claim is supported depends on the medical assessment and other evidence connecting the injury and losses to the incident. Additional testing should be determined by qualified healthcare professionals.
What if My Brain Injury Symptoms Appeared Days After the Accident
Obtain medical evaluation and report when each symptom began. Delayed symptoms do not automatically defeat a claim, but the chronology and medical explanation matter. Do not assume that later recognition of symptoms restarts a legal deadline.
Do I Need a Permanent Injury to Have a Brain Injury Claim
No. A temporary injury may support recoverable losses. However, certain motor-vehicle claims require a qualifying injury under Florida's threshold law to recover pain-and-suffering damages. Whether that rule applies depends on the claim and coverage involved.
Can I Recover if I Had a Previous Concussion or Headaches
Possibly. Prior symptoms require careful comparison with the person's condition after the incident. An aggravation may be compensable when supported by the evidence. Disclose prior injuries honestly so the medical and legal analysis addresses the complete history.
Can I Pursue Compensation if I Returned to Work
Yes, potentially. Returning to work does not automatically eliminate medical expenses or other compensable losses. Records of reduced hours, accommodations, performance changes, and medically supported restrictions may help explain continuing limitations.
How Long Does a Traumatic Brain Injury Case Take to Settle
There is no fixed settlement timeline. The medical prognosis, evidence, insurance limits, disputed liability, and need for litigation affect timing. We discuss opportunities for resolution alongside the risk of settling before future needs can be evaluated adequately.
Can My Family Contact a Hollywood TBI Lawyer for Me
Yes. A relative can request an initial consultation and help organize information. If the injured person cannot make legal decisions, the firm must determine who has authority to act. Being a spouse or adult child does not resolve every representation issue automatically.
How Much Does a Hollywood Brain Injury Attorney Cost
Consultations are free. Daniel B Reinfeld, PA handles accepted personal injury cases on a contingency fee basis, with no attorney's fee unless compensation is recovered. The written agreement explains the fee and how litigation costs are handled.
What Should I Bring to a Free Brain Injury Consultation
Bring available incident reports, discharge instructions, medical and insurance information, photographs, witness details, and records of missed work. A short symptom and treatment timeline is helpful. Do not delay contacting the firm because some records are missing.
Do All Brain Injury Claims Go to Trial
No. Some resolve through negotiations or mediation. Others require a lawsuit and potentially trial. Dan evaluates settlement proposals with the client and prepares the evidence needed to continue the claim when a reasonable resolution is unavailable.
