Aventura Spinal Injury Claims: Attorneys Credentials and Recognition
Daniel B. Reinfeld is AV Preeminent® 5.0 out of 5 Peer Review Rated by Martindale-Hubbell and holds Avvo’s highest attorney rating, 10.0 “Superb.” Dan obtained a $1.6 million unanimous jury verdict in a motor-vehicle case involving an injured pedestrian, included in TopVerdict’s Top 100 Verdicts in Florida for 2024. He is a Life Member of the Million Dollar Advocates Forum and Multi-Million Dollar Advocates Forum, whose membership is limited to attorneys who served as lead counsel in qualifying million- and multimillion-dollar verdicts or settlements. Fewer than 1% of U.S. lawyers are members. Every recovery depends on the facts, law, evidence, and insurance coverage; past results do not guarantee a similar outcome
Aventura Spinal Cord Injury Attorney With Proven Trial Experience
After a spinal cord injury, your family may be worried about recovery, getting home, and how everyday life will change, while questions about work, caregiving, and medical bills arrive all at once. Dan takes the time to listen, explain your options, and identify what needs attention first. Insurers value a catastrophic injury claim by what a jury is likely to do, so they pay attention to which lawyers will actually try one. Dan has tried cases to verdict, including a $1.6 million unanimous jury verdict for an injured pedestrian, and he spent years on the insurance-defense side learning how carriers evaluate, discount, and settle serious injury claims. That experience shapes how he prepares an Aventura spinal cord injury case from day one: evidence preserved early, medical proof built to withstand a defense examination, and a claim valued by the care you will need, not by the first offer. These credentials reflect Dan’s broader trial practice and are not a prediction for any one case. Review selected jury verdicts and settlements. Every recovery depends on the facts, the law, the evidence, and the available insurance coverage, and past results do not guarantee a similar outcome.
Spinal Cord Injury Symptoms and Emergency Warning Signs
The symptoms of a spinal cord injury are loss of movement, loss of sensation, and loss of control of the bladder or bowel, usually below the level of the injury. Other symptoms include severe pain or pressure in the neck or back, weakness, numbness or tingling in the hands or feet, muscle spasms, abnormal pain or temperature sensations, and difficulty breathing or coughing. The National Institute of Neurological Disorders and Stroke explains how these effects depend on where the cord is injured.
Call 911 after an accident if there is new weakness or paralysis, loss of sensation, difficulty breathing, severe neck or back pain, or loss of bladder or bowel control. If a spinal injury is suspected, avoid unnecessary movement and follow the dispatcher's instructions. Do not wait for a legal consultation before seeking care. HCA Florida Aventura Hospital, at 20900 Biscayne Boulevard, is designated a Level II trauma center by the Florida Department of Health.
Symptoms can also develop or worsen after the first emergency evaluation, so report every new change to your treating team and keep every follow-up appointment. Most neck pain after a crash is a soft tissue injury rather than a cord injury. Our guides explain what whiplash is in Florida, whether whiplash can cause nerve damage, and how long whiplash lasts. If an examination points to the spinal cord, the sections below apply instead.
What Is Damage to the Spinal Cord?
Damage to the spinal cord is injury to the bundle of nerve tissue that carries signals between the brain and the body. Trauma can bruise, compress, stretch, or tear the cord, and the effects depend on where along the cord the injury sits and how much of the cord is affected. The higher the injury, the more of the body it can reach.
A broken vertebra or a herniated disc does not by itself establish damage to the spinal cord. Those injuries can be serious, and they can injure the cord or the nerve roots, but the neurological examination and imaging determine which structures were actually harmed. That distinction controls the diagnosis, the prognosis, and the proof your claim needs. Our Hollywood spinal cord injury lawyer page covers the same medical framework for clients in Broward County.
Types of Spinal Cord Injury
The types of spinal cord injury are classified in two ways: by how much function remains below the injury, which is complete or incomplete, and by which parts of the body are affected, which is paraplegia or tetraplegia. Spinal cord injury types also include named incomplete patterns such as central cord syndrome. Your type is established by your neurological examinations, not by a label alone.
Complete and incomplete spinal cord injury
Clinicians grade the injury with the ASIA Impairment Scale. Grade A is a complete injury, meaning no sensory or motor function in the lowest sacral segments. Grades B, C, and D are incomplete injuries with progressively more preserved function, and grade E is normal. Complete does not mean the cord was physically severed. The American Spinal Injury Association's patient guide explains the examination.
Incomplete injuries are the most common. The National Spinal Cord Injury Statistical Center’s 2026 report identifies incomplete tetraplegia as the largest category in its data since 2015, accounting for 47.7% of injuries, followed by incomplete paraplegia at 20.4%, complete paraplegia at 19.6%, and complete tetraplegia at 11.8%. An incomplete injury can still substantially affect independence, employment, and daily care. Your claim should document your actual limitations and future needs.
Paraplegia and quadriplegia (tetraplegia)
Quadriplegia, also called tetraplegia, is impairment of function in the arms, trunk, legs, and pelvic organs from an injury to the cervical spinal cord in the neck. Injuries in the upper neck can also affect breathing. Paraplegia is impairment of the trunk, legs, and pelvic organs from an injury to the thoracic, lumbar, or sacral cord, and arm function is generally spared. Clinicians further group cervical injuries as high tetraplegia (C1 through C4) and low tetraplegia (C5 through C8), and the level matters a great deal to future care costs.
Central cord syndrome and other incomplete patterns
Central cord syndrome is an incomplete cervical injury that commonly affects the arms and hands more than the legs, so a person may walk and still be unable to dress, cook, or work with their hands. Other incomplete patterns have their own names and effects. Cauda equina syndrome is different again: it involves compression of the nerve roots below the end of the cord, and the American Association of Neurological Surgeons explains its urgent warning signs. Paralysis can also come from brain injury or peripheral nerve injury, so a claim must identify the actual diagnosis and its cause. If the same accident caused head trauma, see our Hollywood brain injury lawyer page.
How Spinal Cord Injuries Happen in Aventura
Vehicle crashes and falls account for nearly 70% of traumatic spinal cord injuries in the NSCISC’s data since 2015. In Aventura, these injuries may follow a collision, a condominium fall, or another preventable incident. Dan investigates what happened, identifies potentially responsible parties, and examines available insurance coverage.
Car, truck, and rideshare crashes
Rear-end collisions, rollovers, and side-impact crashes can cause serious spinal injuries. On Biscayne Boulevard, Aventura Boulevard, the William Lehman Causeway, and the Ives Dairy Road and I-95 corridor, an investigation may involve several drivers, commercial vehicles, or rideshare activity. Depending on the evidence and applicable law, responsible parties may include a negligent driver, vehicle owner, employer, trucking company, or rideshare company. Dan examines crash reports, video, vehicle data, and witness accounts to establish liability. See our pages on Aventura rideshare accidents, truck accident claims, and the general car accident lawyer page.
Pedestrian and motorcycle accidents
People on foot and on motorcycles have no vehicle around them, and a collision with a car can cause spinal trauma directly or through the fall that follows. Read about Aventura pedestrian accident claims and Aventura motorcycle accident claims.
Falls in condominiums, hotels, and commercial property
Aventura is a community of high-rise condominiums, hotels, and large retail properties. Falls in condominium stairwells, parking structures, hotels, stores, and pool areas can cause serious spinal injuries. Responsibility depends on who controlled the area, what caused the fall, and whether a party failed to meet its legal duties. Depending on the evidence, potentially responsible parties may include a property owner, condominium association, management company, or contractor. Different parties may have applicable insurance coverage. Dan investigates maintenance records, inspection logs, surveillance footage, and prior complaints to determine how the fall happened.
Workplace, construction, and recreational injuries
Falls from ladders and scaffolds, falling objects, and equipment incidents can cause spinal cord injuries at work, and a workplace injury can involve both workers' compensation and a separate claim against a negligent third party. Unsafe diving conditions, defective equipment, and negligent security can also be responsible and require different liability evidence.
Evidence in Aventura Spinal Cord Injury Cases That Disappears Quickly
Surveillance video from condominiums, retail properties, and traffic and business cameras is routinely overwritten on a schedule. Vehicle event data, 911 and dispatch recordings, maintenance and inspection logs, and the physical equipment or defect itself can be lost, repaired, or discarded. Witnesses move and memories fade. We send written preservation demands early, identify every party who may hold evidence, and investigate the scene before it changes. If you or your family can safely do so, photograph the scene, keep your clothing and any damaged equipment, and write down the names of witnesses.
How We Prove a Spinal Cord Injury or Paralysis Claim
A serious diagnosis does not by itself establish who must pay. We prove three things: that another party was legally responsible, that the incident caused or worsened the neurological injury, and what the injury has cost and will cost. Depending on the case, the proof comes from treating physicians, rehabilitation professionals, accident reconstruction or biomechanical experts, witnesses, and employer and earnings records.
Causation is where insurers push hardest. They point to degenerative disease, spinal stenosis, earlier injuries, or a delay in treatment and argue that the neurological loss was already there. We answer with the timeline in the medical records, the first reported symptoms, comparison of imaging, and the opinions of qualified clinicians, and we address prior spinal conditions openly rather than leave them out. Concealing a prior condition does more damage to a claim than the condition does.
For a person with lasting disability, the claim must also account for the future. A life-care plan organizes anticipated medical care, equipment, personal assistance, home and vehicle modifications, and replacement schedules, using the medical prognosis and appropriate professional assessments. An economist then evaluates the financial projections, and a vocational expert addresses lost earning capacity. A wheelchair, for example, is not a single purchase price. It involves seating, fitting, maintenance, replacement, and whether the home and vehicle can accommodate it.
What a Spinal Cord Injury Can Cost Over Time
The spinal cord injury claim must address treatment today and the care you may need for years. The National Spinal Cord Injury Statistical Center’s 2026 Facts and Figures provides historical estimates of injury-related health care and living expenses, expressed in 2025 dollars:
-
High tetraplegia, C1–C4 (AIS A–C): $1,446,827 in the first year and $251,246 each subsequent year.
-
Low tetraplegia, C5–C8 (AIS A–C): $1,045,459 in the first year and $154,128 each subsequent year.
-
Paraplegia (AIS A–C): $705,131 in the first year and $93,409 each subsequent year.
-
Motor functional at any level (AIS D): $472,190 in the first year and $57,353 each subsequent year.
These estimates derive from a 2011 economic study, adjusted to 2025 dollars, and exclude lost wages, benefits, and productivity. The report also shows employment rates of 64.5% at injury and 17.8% one year afterward in its data since 2015. These figures provide context, not a prediction of your recovery or case value. Dan works with appropriate medical, life-care planning, vocational, and financial experts to document your individual needs, including rehabilitation, attendant care, equipment replacement, home modifications, and lost earning capacity.
Compensation in a Florida Spinal Cord Injury Case
Depending on the facts and the law, a claim may include reasonable and necessary medical expenses, hospitalization and surgery, rehabilitation, future treatment, medical equipment, personal and attendant care, home and vehicle modifications, lost income, and reduced earning capacity. Pain and suffering, permanent disability, mental anguish, and loss of enjoyment of life may also be recoverable when legally supported. In a wrongful death case, surviving family members have their own categories of recovery.
Medical bills are not automatically recoverable at their face amount. Florida Statutes section 768.0427 governs the evidence and recovery of medical expenses, including paid charges, unpaid treatment, future care, and letters of protection.
There is no reliable settlement average that determines the value of a spinal cord injury claim, and self-reported averages from law firm websites do not come with a methodology. We evaluate liability, the neurological and functional evidence, expected lifetime care, ability to work, insurance limits, collectibility, and litigation risk. We explain the basis of every offer and your options for continuing the case before you decide whether to settle.
Florida Laws That Affect an Aventura Spinal Cord Injury Claim
Filing deadline
Section 95.11, Florida Statutes, generally gives two years to file a negligence action, and wrongful death claims also carry a short deadline. The incident date, the defendant, and possible exceptions require individual review. Claims against a government entity follow separate notice rules under section 768.28. Do not assume that continuing treatment or uncertainty about your recovery extends a deadline.
Where the case is filed
Under section 47.011, a civil action is brought in the county where the defendant resides, where the cause of action accrued, or where the property in litigation is located. For an injury in Aventura, that generally means Miami-Dade County, even though our office is in Hollywood. We handle the case where it belongs.
Comparative fault
Under section 768.81, a claimant's share of fault reduces recoverable damages in a negligence action. A person found more than 50 percent responsible for their own harm cannot recover damages in an action governed by the modified comparative-fault rule. At exactly 50 percent that rule does not bar recovery, but damages are reduced. Insurers use this rule aggressively, which is why the evidence of how the incident happened matters from the first day.
PIP and the motor vehicle injury threshold
When Florida no-fault applies, section 627.736 requires qualifying initial medical services within 14 days for PIP medical benefits, which is a different deadline from the one for filing a lawsuit. For claims subject to section 627.737, pain-and-suffering damages require a qualifying injury, such as a permanent injury within a reasonable degree of medical probability or a significant and permanent loss of an important bodily function. A spinal cord injury with lasting neurological loss ordinarily fits those categories, but the medical opinion still has to be obtained and documented.
Uninsured and underinsured motorist coverage
Spinal cord injuries often exceed a responsible driver's liability coverage. Uninsured and underinsured motorist coverage on your own policy, or on a household or occupied vehicle's policy, may be important, and a liability release signed too early can affect it. Our uninsured motorist lawyer page explains the coverage issues.
Workplace injuries
Florida workers' compensation law, in section 440.15, lists certain severe spinal cord injuries among the conditions treated as permanent total disability. A workers' compensation claim does not stop you from pursuing a negligent third party, and section 440.39 addresses those claims and the carrier's reimbursement rights. We evaluate whether a separate claim exists and how the benefits and any reimbursement interact.
Rehabilitation and Support Resources Near Aventura
These are independent community and public resources. Their inclusion does not imply an affiliation with our firm.
HCA Florida Aventura Hospital, at 20900 Biscayne Boulevard, is designated a Level II trauma center by the Florida Department of Health. The state's trauma center listing shows Jackson Memorial Hospital and the Ryder Trauma Center as a Level I trauma center in Miami-Dade County. Spinal cord rehabilitation is available at the Christine E. Lynn Rehabilitation Center for The Miami Project to Cure Paralysis at UHealth/Jackson Memorial, which opened in 2021, and UHealth Jackson Rehabilitation Care at Jackson North, 160 N.W. 170th Street in North Miami Beach. The Model Systems Knowledge Translation Center offers educational resources on mobility, personal care, skin protection, and adjustment after injury.
The Florida Department of Health's Brain and Spinal Cord Injury Program helps eligible Florida residents with moderate-to-severe spinal cord injuries obtain services. Section 381.76 sets the eligibility requirements, and a person who meets them may refer themselves through the program's Central Registry at 1-800-342-0778. Section 381.785 addresses recovery of third-party payments for services the program funds, so tell Dan about any program benefits you receive before you settle a claim.

Aventura Spinal Cord Injury and Paralysis Lawyer FAQs
Can my family contact the firm while I am hospitalized?
Yes. A family member can request an initial discussion and help organize information. Authority to make legal decisions must be established when required, and hospital visits can be arranged when appropriate.
How much does a spinal cord injury lawyer cost?
Consultations are free. Accepted cases are handled on a contingency fee, so there is no attorney's fee unless compensation is recovered. The written agreement explains fees and litigation costs.
What should I bring to a consultation?
Bring any incident reports, discharge instructions, medical and insurance information, photographs, and work-loss records. Missing records should not delay the first call.
Do you represent North Miami Beach spinal cord injury clients?
Yes. Dan represents North Miami Beach residents and people injured in North Miami Beach, along with clients in Aventura, North Miami, Sunny Isles Beach, and the rest of Miami-Dade and Broward Counties. Consultations are free by phone or Zoom, and a hospital or home visit can be arranged when appropriate.
Can I have a spinal cord injury claim if I can still walk?
Yes. Walking ability does not rule out an incomplete spinal cord injury or substantial functional limitations such as weak hands, pain, spasticity, or bladder and bowel problems. The diagnosis, your symptoms, and the supported losses decide the claim.
What is the difference between paraplegia and quadriplegia?
Paraplegia affects the trunk, legs, and pelvic organs. Quadriplegia, also called tetraplegia, affects the arms as well and can affect breathing. Your treating team determines the pattern, severity, and prognosis.
Does a complete spinal cord injury mean the cord was severed?
No. Complete is a clinical classification based on the absence of sensory and motor function in the lowest sacral segments. It does not necessarily mean the cord was physically cut.
How much is a spinal cord injury case worth?
It depends on liability, the neurological and functional evidence, the lifetime care plan, lost earning capacity, and the available insurance. No reliable average exists. The national cost data above shows why these claims can run into the millions, but the value of your claim comes from your own records and expert analysis.
How long do I have to file a spinal cord injury lawsuit in Florida?
Section 95.11 generally allows two years for a negligence action, and government-related claims have separate notice rules. Call early, because evidence is lost long before a deadline arrives.
Is a herniated disc the same as a spinal cord injury?
No. A herniated disc involves a spinal disc, while a spinal cord injury is damage to the cord itself. A disc injury can affect the cord or a nerve root, and the neurological findings establish which was injured.
What if my weakness or paralysis developed after the accident?
Get emergency medical evaluation for any new or worsening neurological symptom. A later change does not by itself establish or defeat causation. The medical evidence and the timeline decide it.
What if the insurer says my condition was preexisting?
You may still have a claim. Prior records, imaging comparisons, and functional history can show what the incident caused or made worse. Disclose prior conditions so the evaluation addresses your full history.
What if I was partly at fault?
You may still recover. Under section 768.81, your share of fault reduces your damages, and more than 50 percent fault bars recovery in an action governed by the modified comparative-fault rule.
Can the claim include home modifications and future care?
Yes, when medically and legally supported. Evidence may address attendant care, equipment, accessible housing, transportation, rehabilitation, and replacement costs, and the claim must connect each need to the injury.
What if the injury happened at work?
Workers' compensation benefits may be available, and you may also have a claim against a negligent third party. Section 440.39 addresses the carrier's reimbursement rights, and we evaluate how the two interact.
What if a family member died from a spinal cord injury?
Florida's Wrongful Death Act may allow the personal representative of the estate to bring a claim for the family. Deadlines are short, so contact us as soon as you can.
