Hollywood Spinal Cord Injury Law Firm for Paralysis, Paraplegia, and Quadriplegia Claims

$1.6 Million Motor-Vehicle Jury Verdict | 25+ Years in Practice | Former Insurance-Defense Attorney

After a spinal cord injury, you and your family may be worried about recovery, getting home, and how everyday life will change. Questions about work, caregiving, and medical bills can arrive all at once. Dan takes the time to listen, explain your options, and identify what needs attention first. You work directly with the attorney handling your case.

With more than 25 years of litigation experience and approximately six years defending insurers and insureds, Dan understands how serious injury claims are investigated and challenged. He builds the claim around the evidence and the support you may need in the years ahead, while keeping you informed about settlement and trial decisions.

Spinal Cord Injury and Paralysis Claims at a Glance

  • Spinal cord damage differs from an injury limited to the discs, bones, or muscles of the neck or back.

  • Paraplegia and quadriplegia describe patterns of impairment; complete and incomplete describe a clinical classification of the cord injury.

  • A claim requires proof of legal responsibility, a connection between the incident and injury, and supported losses.

  • Future care may involve equipment, personal assistance, rehabilitation, accessible housing, transportation, and reduced earning capacity.

  • Florida negligence actions generally have a two-year filing deadline, but the applicable rule depends on the claim and circumstances.

Hollywood Spinal Injury Claims: Attorneys Credentials and Recognition

Daniel B. Reinfeld is AV Preeminent® 5.0 out of 5 Peer Review Rated by Martindale-Hubbell and holds Avvo’s highest attorney rating, 10.0 “Superb.” Dan obtained a $1.6 million unanimous jury verdict in a motor-vehicle case involving an injured pedestrian, included in TopVerdict’s Top 100 Verdicts in Florida for 2024. He is a Life Member of the Million Dollar Advocates Forum and Multi-Million Dollar Advocates Forum, whose membership is limited to attorneys who served as lead counsel in qualifying million- and multimillion-dollar verdicts or settlements. Fewer than 1% of U.S. lawyers are members. As a slip and fall attorney that Broward County residents can consult, Dan brings this litigation background to evaluating local injury claims. These credentials reflect Dan’s broader trial and injury practice. For other selected matters, review jury verdicts and settlements. Every recovery depends on the facts, law, evidence, and insurance coverage; past results do not guarantee a similar outcome.

Suspected Spinal Injury and Emergency Warning Signs

Call 911 after an accident if there is new weakness or paralysis, loss of sensation, difficulty breathing, severe neck or back pain, or loss of bladder or bowel control. If a spinal injury is suspected, avoid unnecessary movement and follow the emergency dispatcher's instructions. The National Institutes of Health describes warning signs of spinal cord injury and the need for careful emergency assessment.

New difficulty urinating, numbness in the groin or saddle area, or progressive leg weakness also requires immediate medical evaluation. These symptoms may indicate cauda equina syndrome or another neurological emergency. Do not wait for a legal consultation before seeking care.

What Is a Spinal Cord Injury

A spinal cord injury involves damage to the nerve tissue carrying signals between the brain and body. Trauma may injure the cord through compression, bruising, stretching, or other damage. The effects depend on the location and extent of injury. The National Institute of Neurological Disorders and Stroke explains how SCI can affect movement, sensation, and body functions. A broken vertebra or herniated disc does not automatically establish spinal cord damage. Those injuries can be serious, but the diagnosis and neurological findings determine whether the spinal cord, nerve roots, or other structures were injured. Not every person with an SCI has the same limitations, and some retain the ability to walk.

Complete and Incomplete Spinal Cord Injury

Clinicians classify SCI through neurological examination, including whether sensation or voluntary movement remains in the lowest sacral pathways. This distinction is called sacral sparing. A clinically complete injury lacks the specified sacral sensory and motor function; an incomplete injury preserves qualifying function. Complete does not necessarily mean the cord was physically severed. The American Spinal Injury Association's patient guide explains the examination and ASIA Impairment Scale (AIS). These findings help describe the injury and track changes. They do not replace an individualized prognosis.

Paraplegia and Quadriplegia or Tetraplegia

Paraplegia generally affects the legs and may affect the trunk and pelvic functions. Quadriplegia, also called tetraplegia, affects the arms and legs and may involve the trunk and breathing. Cervical cord injuries can affect all four limbs; injuries farther down generally spare arm function. The pattern and severity must be established from the person's examinations rather than assumed from a label alone. Our Hollywood paralysis attorney evaluates the consequences for the individual: hand function, transfers, personal care, mobility, communication needs, and the assistance required to participate in daily life.

Central Cord Syndrome and Other Incomplete Injuries

Central cord syndrome is an incomplete cervical cord injury that commonly affects the arms and hands more than the legs. Preserved walking ability can coexist with substantial limitations. Other incomplete injury patterns also require careful specialist evaluation and documentation of the functions actually affected.

Cauda Equina Injury and Other Causes of Paralysis

The cauda equina consists of nerve roots below the end of the spinal cord. Compression or injury to these nerves can affect leg strength, saddle sensation, and bladder or bowel function. It is distinct from an injury to the cord itself. The American Association of Neurological Surgeons explains the urgent symptoms and evaluation of cauda equina syndrome. Paralysis can also arise from brain or peripheral nerve injuries and nontraumatic conditions. A legal claim must identify the actual diagnosis and cause. If the same accident also caused head trauma, our Hollywood brain injury lawyer pageexplains the related TBI issues.

Accidents That Can Cause Spinal Cord Injuries in Hollywood

We evaluate negligence claims involving:

  • Car and truck collisions: Rear-end, head-on, side-impact, rollover, and other crashes may require investigation of vehicle forces, occupant movement, restraints, and responsible drivers or businesses. See our Hollywood car accident lawyer and truck accident claims pages.

  • Motorcycle, bicycle, pedestrian, and e-bike accidents: A vehicle impact or subsequent fall can cause serious spinal trauma. Explore our Hollywood motorcycle accident representation and pedestrian accident claims.

  • Falls on unsafe property: Stairway falls, unsafe walking surfaces, and other conditions require proof of the hazard and the defendant's legal responsibility. Our Hollywood slip and fall lawyer page explains premises-liability issues.

  • Construction and workplace incidents: Falls from heights, equipment events, and falling objects may involve workers' compensation and a separate claim against a responsible third party.

  • Other preventable incidents: Unsafe diving conditions, recreational incidents, negligent security, or defective equipment may require different liability evidence.

For incidents on I-95, Hollywood Boulevard, Sheridan Street, US 1, at Hollywood Beach, or elsewhere in the community, we investigate the actual scene and circumstances. Surveillance, witnesses, property records, vehicle data, and physical evidence can be important before repairs or routine deletion make them unavailable.

Long Term Effects of Spinal Cord Injury and Paralysis

An SCI can affect more than the ability to walk. Depending on the injury, care may address changes in hand function, pain, muscle spasticity, bladder and bowel function, breathing, sexual function, and skin protection. Emotional adjustment and the effect on family life also deserve attention. The Model Systems Knowledge Translation Center's SCI resources address these concerns individually. The legal claim should reflect the problems actually documented, rather than assume every possible complication will occur. We review what the person can do independently, what assistance is needed, and which needs are expected to continue. Changes in function during rehabilitation should be incorporated into the evidence. Improvement in one activity does not necessarily resolve limitations in another.

How We Prove a Spinal Cord Injury or Paralysis Claim

A serious diagnosis does not by itself establish who must pay. We investigate the defendant's responsibility, how the incident caused or worsened the injury, and the resulting losses. Depending on the case, the evidence may come from treating providers, rehabilitation professionals, witnesses, and qualified litigation experts.

Establish Fault and Preserve Incident Evidence

Relevant materials may include crash and incident reports, photographs, surveillance recordings, witness accounts, vehicle event data, maintenance records, inspection documents, and equipment. Responsibility may involve a driver, employer, property operator, contractor, or another party, depending on the evidence and applicable law. We also review available insurance and any competing claims to limited coverage.

Connect the Trauma to the Neurological Findings

Medical records can document the first reported symptoms, neurological examinations, CT or MRI findings, surgery, and rehabilitation progress. NIH information on SCI diagnosis explains the roles of examination and diagnostic testing. A qualified clinician must interpret those findings in the context of the person's history.

If the injury mechanism is disputed, reconstruction or biomechanical analysis may help explain the event. That work complements clinical evidence; it does not replace a medical diagnosis. Prior spinal disease, stenosis, earlier injuries, and preexisting limitations should be addressed honestly rather than omitted from the evaluation.

Document What Changed in Daily Life

Rehabilitation notes, work restrictions, assistive-device assessments, and accounts from the injured person and family can explain changes that a scan alone cannot show. Relevant activities may include dressing, bathing, transferring, preparing meals, driving, and completing work tasks. Evidence should describe the assistance needed, how often it is needed, and the basis for any projected long-term limitation.

Future Care and Life Care Planning After Paralysis

For a person with lasting disability, a claim should consider supported future needs as well as bills already received. A life-care plan organizes anticipated services, equipment, and assistance using the medical prognosis and appropriate professional assessments. An economist may then evaluate the financial projections, including replacement schedules and other supported assumptions.

For example, documenting a wheelchair need may require more than a purchase price. The evidence may need to address seating, fitting, maintenance, replacement, and whether the home or vehicle can accommodate it. These are possible planning issues, not an assumption that every patient needs the same equipment or services.

Compensation in a Florida Spinal Cord Injury Case

Depending on the facts and law, a claim may include reasonable and necessary medical expenses, rehabilitation, future treatment, equipment, assistance, lost income, and reduced earning capacity. Pain and suffering, disability, mental anguish, and loss of enjoyment of life may also be recoverable when legally supported.

Medical bills are not automatically recoverable at their face amount. Florida Statutes section 768.0427 governs evidence and recovery of medical expenses, including paid charges, unpaid treatment, future care, and letters of protection.

What Is a Spinal Cord Injury or Paralysis Settlement Worth

There is no reliable settlement average that determines the value of an individual SCI claim. We evaluate liability, the neurological and functional evidence, expected care, ability to work, insurance limits, collectibility, and litigation risks. Neither a diagnosis alone nor another person's verdict establishes what your case should recover. We explain the basis of an offer and the options for continuing the claim before you decide whether to settle.

Florida Laws and Insurance Rules Affecting SCI Claims

Filing Deadlines

Florida Statutes section 95.11 generally provides two years for negligence actions. The incident date, type of claim, defendant, and possible exceptions require individual review. Government-related matters may have separate notice procedures. Continuing treatment or uncertainty about recovery should not be assumed to extend a deadline.

Comparative Fault

Under section 768.81, a claimant's share of fault generally reduces recoverable damages. In negligence actions governed by the modified comparative-fault rule, a person found more than 50 percent responsible for their own harm cannot recover damages. At exactly 50 percent, that rule does not bar recovery, but damages are reduced. The applicable rules depend on the particular action.

PIP and the Motor Vehicle Injury Threshold

When Florida PIP applies, section 627.736 requires qualifying initial medical services within 14 days for medical-benefit eligibility. This requirement is different from the deadline for filing a negligence lawsuit.

For claims subject to section 627.737, pain-and-suffering damages require a qualifying injury, such as permanent injury within a reasonable degree of medical probability or significant and permanent loss of an important bodily function. The applicable threshold must be proved rather than assumed from a diagnostic label.

UM Coverage and Workplace Claims

Uninsured or underinsured motorist coverage may be important when a responsible driver's bodily-injury coverage is absent or insufficient. Entitlement depends on the policy and legal requirements. Our Hollywood uninsured motorist lawyer page explains coverage considerations. A proposed liability release should be reviewed for its effect on any UM claim.  For workplace injuries, workers' compensation and third-party liability follow different rules. Section 440.39 addresses claims involving third-party negligence and related compensation rights. Our firm evaluates whether a separate claim is available and how benefits and potential reimbursement issues interact.

Hollywood Spinal Cord Injury Rehabilitation and Family Resources

Memorial Regional Hospital in Hollywood, at 3501 Johnson Street, provides Level I trauma services for serious injuries, including spinal cord trauma. Memorial Rehabilitation Institute's spinal cord injury program describes individualized rehabilitation, physical and occupational therapy, peer mentoring, and support groups. These are independent community resources; their inclusion does not imply an affiliation with our firm. The Model Systems Knowledge Translation Center provides educational resources on mobility, personal care attendants, respiratory health, skin protection, bladder and bowel management, employment, and adjustment after SCI. Families can discuss relevant resources with the treating team. Rehabilitation goals and support needs differ from person to person.

Hollywood Spinal Cord Injury and Paralysis Lawyer FAQs

Can I Have a Spinal Cord Injury Claim if I Can Still Walk

Yes, potentially. Walking ability does not rule out an incomplete SCI or substantial functional limitations. The diagnosis, symptoms, and supported losses matter. MSKTC explains that walking ability after SCI varies.

Is a Herniated Disc the Same as a Spinal Cord Injury

No. A herniated disc involves a spinal disc; SCI involves damage to the cord. A disc problem may affect the cord or nerve roots, but the medical evidence must establish which structures were injured.

What Is the Difference Between Paraplegia and Quadriplegia

Paraplegia generally affects the lower body. Quadriplegia, or tetraplegia, affects all four limbs and may involve other functions. The treating team determines the pattern, severity, and prognosis.

Does a Complete Spinal Cord Injury Mean the Cord Was Severed

No. Complete is a clinical classification based on specified neurological findings, including absent sacral sensory and motor function. It does not necessarily describe a physically severed spinal cord.

Can a Paralysis Claim Include Future Care and Home Modifications

Yes, when medically and legally supported. Evidence may address necessary assistance, equipment, accessible housing, transportation, rehabilitation, and replacement costs. The claim must connect those needs to the injury.

What if My Weakness or Paralysis Developed After the Accident

Seek emergency medical evaluation for new or worsening neurological symptoms. A later change does not by itself establish or defeat causation; the medical evidence and timeline must be evaluated.

Can I Bring a Claim if the Insurer Says My Condition Was Preexisting

Possibly. Prior records, imaging comparisons, examinations, and functional history can help determine what the incident caused or worsened. Disclose prior conditions so the evaluation addresses the complete history.

Can I Pursue a Claim if I Was Partly at Fault

Possibly. For negligence actions governed by Florida's modified comparative-fault rule, fault reduces damages, and more than 50 percent fault bars recovery. Applicability depends on the claim.

How Long Does a Spinal Cord Injury Case Take to Settle

There is no fixed timeline. Prognosis, evidence, insurance, disputed liability, and litigation affect timing. Settlement should be evaluated alongside supported future needs and the risks of continuing the case.

How Much Does a Hollywood Spinal Cord Injury Attorney Cost

Consultations are free. Accepted personal injury cases are handled on a contingency fee basis, with no attorney's fee unless compensation is recovered. The written agreement explains fees and litigation costs.

Can My Family Contact the Firm While I Am Hospitalized

Yes. A family member can request an initial discussion and help organize information. Authority to make legal decisions must be established when required. Hospital or video consultations can be arranged when appropriate.

What Should I Bring to a Spinal Cord Injury Consultation

Bring available incident reports, discharge instructions, medical and insurance information, photographs, and work-loss records. Information about rehabilitation and assistance needs is useful. Missing records should not delay an initial call.
